Prevalence of Small-Mindedness, Bias, Dishonesty, Moral Corruption in Swiss Justice System... | And Some Strange Legal Decisions...

Switzerland has a lot of positive aspects. People who have a special love for music. Breathtaking natural beauty. Great public transport. But unfortunately the coverage of RF EMF radiation (5G, 4G, WiFi, Bluetooth...) is ridiculously high, and the dishonesty around the topic by the industry and government is unbelievable. We have proof of lies coming from every corner.

Switzerland is scary when it comes to protection of rights and competence of the justice system. The problems are deep rooted. One of the key issues in the Swiss government system is that there are often people in very high positions of authority, without the necessary competence. For example, Simonetta Sommaruga who is now the President of Switzerland, was the Minister of Justice, and she has no justice, law, in her formal qualifications. She's a concert pianist!

So what happens, in my opinion, when a person without the necessary background / competence, takes over a ministry, they cannot possibly be disruptive, to "drain the swamp", to reengineer processes, to clean up the mess, to improve the organization. They rely on continuation of status quo. And over the decades, status quo piles up and ends up as a massive mess.

The Swiss justice system today, in my opinion, based on extensive research, is in need of significant reform as in my view, it's marred with bias, incompetence and small-mindedness.

I decided to write this article as a collection of some crazy stories I've come across by doing some simple Google search. I will add to it, in time, my own personal experience as a victim of two racist attacks on Swiss streets, and the tragedy that followed, that was supposed to be justice but it was a mockery of justice at the morally corrupt level as we read about corrupt dictatorships.

In California once I found someone bending into my car window to take my wallet. I called the police immediately. He ran away. They had him arrested while I was on the phone!! This is how swift and competent they are.

I think an issue with Swiss police is the rose colored glasses that's a big part of the Swiss-German culture: part of the education is to think everything is perfect. Another issue -- which is actually positive -- is that the crime rate is low -- so the police doesn't have much experience dealing with heavy crime.

25 Swiss prosecutors did not study law, do not have a law degree!!

A Swiss lawyer told the Swiss public prosecutor who had not studied law: "You are like a bicycle mechanic who works as an operating doctor!" The lawyer was fined 500 Francs (around $500) for expressing that opinion which the court considered as a degrading statement against the professional rules! The lawyer appealed it. The Federal court upheld the judgment saying the sentence was "unnecessarily hurtful and polemical". (polemical = being polemic = an aggressive attack on or refutation of the opinions or principles of another). The prosecutor resigned.

The article cites SonntagsBlick survey that showed 25 prosecutors still don't have a law degree, with the greatest number being in Kanton Aargau, where I lived for a long time, and saw first hand, when I was a victim of a racist attack, how biased and backward the approach to law was.

I've heard of numerous cases of foreign-born people (even Swiss citizens of foreign origin) whose rights were violated by a native-Swiss, and horror stories about how the justice system was incredibly biased, in favor of the native-Swiss. I experienced this first-hand and uncovered a level of moral corruption (dishonesty, disregard for truth...) that I thought could only be found in corrupt dictatorships.

I did not make up that mind-boggling headline. It's true. To make it worse, the prosecutor even admitted there was no evidence that any serious crime was committed. Yet they raided the journalist's house at morning twilight, took his computers, etc. -- why ? because Le Matin journalist, Ludovic Rocchi had published evidence to show a key textbook at University of Neuchâtel was plagiarized. A university director filed a charge against the journalist.

The prosecutor who ordered the raid was Nicolas Auber, whom since then has been promoted to the Cantonal Assistant Prosecutor General. The case was eventually sent to the Tribunal for Coercive Measures. In German it's called Zwangsmassnahmengericht (ZMG) and is a part of the Appellate Court system, and oversees remand, etc.

According to various online articles, the court determined that the raid ordered by Prosecutor Nicolas Auber was illegal and extreme compared to what Ludovic Rocchi was charged with (not respecting the principle of proportionality). Can you imagine the pain that Mr. Roschi went through, and the degradation by having police burst into his home to take his devices without his permission, for a completely unfounded reason. This happens in the most corrupt dictatorships.

Furthermore, an administrative review revealed that plagiarism had indeed occurred. Mr. Rocchi was right after all. He invoked Article 10 of the ECHR. The prosecutor had wanted to convict Mr. Rocchi. Four years later, the court acquitted Mr. Rocchi of all charges. Swiss court convicted someone of a crime for "Liking" a Facebook post!! [I'm not making this up -- I read it in the news!]

I read it in the news that a Swiss court convicted someone of a crime by liking a FB post!

I can understand if someone shares an unlawful post - that would be unlawful - but to click "Like" on it? That's going way too far!! But not for a Swiss court that effectively said even if you don't have a good understanding of the post's content, even if you would not write that post yourself, but you clicked Like anyway, you're considered a criminal !! This actually happened in a case where a guy was fined about $4000 and ended up with a criminal record! The judge, Catherine Gerwig wrote: "By clicking on a Facebook Like button, the defendant was endorsing the defamatory content and making it his own"!!

A social media comment to this story by Al Maturo: "Like should not imply ownership. I click Like for a wide variety of reasons, not all of which mean I agree with the content".

Swiss Prosecutor (Vaud) refused to take Kosovar woman who complained about extreme, long-term domestic violence, and ordered husband's lawyer fees paid!

According to the woman, the violence, verbal and physical, began as soon as she arrived in Switzerland, after her marriage. She described an extensive series of abuses. The prosecutor closed the case saying it happened behind closed doors so it's one person's word against another! And ordered husband's legal fees paid (about $10,000). She appealed the decision. The court said the prosecutor must take the case.

Swiss Court (Zurich) penalizes journalists who exposed insurance malpractice!

Canton Zurich Court of Appeal (Obergericht) found journalists guilty of invasion of privacy because they recorded insurance agent secretly, to reveal malpractice. European Court of Human Rights overturned the judgement. "The ECtHR’s ruling reiterated that public interest journalism is protected by the ECHR, even when it interferes with the right to private life."
